Terms of Service

1. Acceptance of terms

By accessing and using the Pixelum Digital website or contracting our services, you agree to be bound by these terms of service. If you disagree with any part of the terms, please do not use our services.

2. Description of services

Pixelum offers web design, application development, e-commerce, and digital consulting services. The specific scope, deliverables, timelines, and fees for each service will be defined in an individual proposal or contract for each project.

3. Proposals and quotes

Economic proposals are valid for 30 calendar days from the date of issuance. Once the proposal is accepted, any significant change to the scope may result in an adjustment to the project timeline and cost.

4. Payment terms

Payment terms are specified in each project proposal. By default:

  • 50% advance payment at project start.
  • Remaining 50% before final deployment or per agreed milestones.
  • Payments are made in the currency and account indicated in the proposal.
  • In case of delay exceeding 15 days, we reserve the right to pause the project.

5. Timelines and deliverables

Delivery timelines are estimates and depend on the availability of information, content, and approvals from the client. Delays in client responses or deliveries may affect the completion date.

6. Intellectual property

Once the project is fully paid, the client receives rights to the source code and visual assets developed specifically for them, with the following exceptions:

  • Third-party libraries, frameworks, or components retain their original licenses.
  • Pixelum reserves the right to showcase the work in its portfolio and social media, unless a confidentiality agreement is expressly signed.

7. Post-delivery warranty

Every project includes a 30 calendar day post-delivery warranty to correct errors attributable to the original development, at no additional cost. This warranty does not cover scope changes, new features, third-party infrastructure modifications, or failures due to misuse.

8. Hosting, domains, and third-party services

The cost of domains, hosting, payment gateways, APIs, and other third-party services is the client's responsibility, unless otherwise specified. Pixelum is not responsible for outages, policy changes, or charges from these third parties.

9. Confidentiality

Both parties agree to treat sensitive information shared during the project with confidentiality. At the client's request, an additional non-disclosure agreement (NDA) can be signed.

10. Project cancellation

The client may cancel a project at any time by notifying in writing. The following conditions apply:

  • The advance payment is non-refundable.
  • Work completed up to the cancellation date will be charged.
  • Partial deliverables are released only after covering the corresponding amount.

11. Limitation of liability

Pixelum will not be liable for indirect, incidental, consequential, or lost-profit damages arising from the use of the services. Our maximum liability is limited to the amount effectively paid by the client for the specific service.

12. Applicable law and jurisdiction

These terms are governed by the laws of Mexico. Any dispute will be resolved before the competent courts of Guadalajara, Jalisco, waiving any other jurisdiction that may apply.

13. Modifications

We reserve the right to update these terms at any time. The current version will be the one published on this page. We recommend reviewing it periodically.
